What it does, and where it goes
The W-8BEN goes to the payer — your broker, the platform, the publisher — not to the IRS. It certifies that you are not a US person and, where the US–UK treaty applies, drops withholding from the 30% default: typically to 15% on dividends and to zero on most interest and royalties.
It remains valid for three calendar years after the year of signature, and dies early if your circumstances change — a move, a new status, a lapsed certification are the usual reasons people quietly slip back to 30%.

Do I need a US tax number to file a W-8BEN?
For portfolio income like dividends, usually not — a UK National Insurance number typically serves as the foreign tax identification number. Certain claims do require a US ITIN, and we advise when yours does.
My broker withheld 30% anyway. Can I get it back?
Often, yes — first from the payer within the correcting window, otherwise by filing a US return to reclaim the excess. Then a fresh W-8BEN stops it recurring.
What's the difference between a W-8BEN and a W-9?
The W-9 is for US persons; the W-8BEN is for foreign persons. If you are a US citizen or Green Card holder living in the UK, a W-9 is the correct form — filing a W-8BEN instead is a misrepresentation with real consequences.
How often do I need to renew a W-8BEN?
It expires at the end of the third calendar year after signing — so a form signed in 2026 lasts through 2029 — or immediately when your circumstances change. Brokers rarely chase renewals loudly; the first sign is usually withholding jumping back to 30%.
Can US citizens living in the UK use a W-8BEN?
No. US citizens and Green Card holders are US persons wherever they live and must give a W-9 instead. Filing a W-8BEN as a US person misstates your status to the payer and can create real problems later.
