What they can actually take when you live here

Compliance · · 13 min read
A wire fence running across clifftop grass and stopping at the edge above an open grey sea, illustrating the point at which an IRS levy runs out of reach over assets held in Britain.
American payers are inside the fence. A bank in Manchester is over the edge, and the notice carries no weight there.

Figures relate to tax year 2025 (US)

A final notice arrives and the word levy is in bold. The natural first thought from Britain is that an IRS levy cannot reach you here.

That is half right, and the half that is wrong costs people a great deal of money.

What matters is which of your assets touch America at all, because those are the ones in range.

Key takeaways

  • A levy seizes property to pay a tax debt, without going to court.
  • American banks, brokers and payers must comply in full.
  • A British bank has no obligation to an American notice.
  • US-source pensions, rent and social security are exposed.
  • A final notice gives you thirty days and a hearing right.
  • Passport certification often arrives before any levy does.
  • A payment plan or settlement stops the process.
  • Ignoring the letters is the only choice with no upside.

What is an IRS levy?

The legal seizure of property to satisfy a tax debt. According to IRS guidance on levies, it differs from a lien, which only secures the debt against your assets. A levy actually takes the money, and it needs no court order to do it.

Our guide to an IRS payment plan from abroad covers the alternative.

A lien stakes a claim. A levy collects.

Can an IRS levy reach a British bank?

Not directly. An American levy notice carries no legal force over a bank in Manchester, which has no obligation to act on it and usually cannot lawfully do so. That is why expats are told, correctly, that their British current account is out of reach.

Our guide to a FATCA letter from a UK bank covers what banks do report.

Reporting your balance and freezing it are different things.

What can an IRS levy take?

Anything held by somebody who answers to American law. A brokerage account in New York, a bank account you kept open in Boston, rent from a property in Florida and a pension paid from an American scheme are all straightforwardly within reach.

Our guide to US property for UK residents covers American rentals.

The question is where the payer sits, not where you do.

Can an IRS levy touch social security?

It is exposed, though only partly. A continuing levy can take a fixed percentage of a social security payment rather than the whole thing, which leaves some income intact. For a retired American abroad that is still a serious bite into a fixed income.

Our guide to social security and the state pension covers the payments.

The British state pension is not reachable.

What notices come before an IRS levy?

A sequence of them, ending with a final notice of intent to levy. That last letter carries a thirty day period and the right to a hearing, and it is the moment the position becomes serious. Everything before it is a demand rather than a threat.

Our guide to a CP2000 notice from abroad covers earlier letters.

Look for the words final notice rather than counting letters.

What is the hearing right?

A collection hearing you request within thirty days of the final notice. According to IRS guidance on collection hearings, it pauses collection while an independent officer considers whether the levy is appropriate and whether an alternative would work better.

Our guide to the Taxpayer Advocate Service covers a different route.

Missing the thirty days leaves a weaker equivalent hearing.

Does an IRS levy notice reach you in time?

Often it does not, which is the cruellest feature of the whole sequence for expats. Thirty days starts from the notice date, and international post can eat half of it. People open the envelope with a week to act.

Our guide to the IRS online account from the UK covers watching for notices.

Check your account online rather than waiting for paper.

Does the passport rule come first?

Usually, and it hurts more. Where a debt is seriously delinquent, which for 2025 meant roughly $65,000 including penalties and interest, the IRS certifies it to the State Department, which can refuse to renew a passport. Abroad that bites harder than a levy on a forgotten account.

Our guide to passport revocation for tax debt covers the certification.

In our practice this is what finally brings people in.

A worked example

Take an illustrative case. An American in Cardiff owes four years of assessed tax and ignores the letters.

His British salary and current account are untouchable, and nothing happens for a while.

Then a levy takes the balance of a brokerage account he had forgotten in Chicago.

A month later his passport renewal is refused, which was the consequence that actually mattered to him.

Can an IRS levy take a UK pension?

No, because a British scheme is a British institution with no American obligation. A pension paid from an American plan to your British address is a different matter and can be levied. The scheme's location decides it.

Our guide to US retirement accounts in the UK covers American plans.

A transferred pot follows its new scheme.

Can an IRS levy take a US property?

They can place a lien on it easily and sell it with more difficulty. Seizing and selling real estate is slow, heavily procedural and used sparingly, but the lien alone stops you selling or remortgaging cleanly. Most owners discover it at closing.

Our guide to selling a UK home as a US citizen covers the disposal side.

A lien is quiet until you try to move the asset.

Does a treaty help collect across borders?

The United States has mutual collection arrangements with a handful of countries, and Britain is not among them for this purpose. So HMRC does not collect American tax debts from British taxpayers. That is the practical reason your British assets stay quiet.

Our guide to the US-UK tax treaty covers what the treaty does do.

Do not rely on that staying true for ever.

How do you stop an IRS levy?

By engaging, which is unglamorous and effective. A payment plan, a settlement offer, or a finding that you genuinely cannot pay all halt collection while they are in place. The IRS stops levying the moment a case is in a collection alternative.

Our guide to an offer in compromise covers settling.

Even a modest monthly plan stops the process.

What if you cannot pay at all?

There is a status for that, and it is worth asking about. Where paying would leave you without basic living costs, the IRS can mark the account as currently not collectible and stop pursuing it. Interest continues, and the pressure stops.

Our guide to reasonable cause relief covers penalty arguments.

British living costs are accepted as evidence here.

Does the debt eventually expire?

Generally after ten years from assessment, which is the collection period. Several things pause that clock, including time spent outside the United States in some circumstances, so counting on it from abroad is risky. Expats often misread this badly.

Our guide to the statute of limitations covers the periods.

Waiting it out is a worse plan than it sounds.

Can an IRS levy be released?

Yes, and quickly in the right circumstances. Where the levy creates genuine hardship, where the debt is already satisfied, or where a plan has since been agreed, the IRS can release it. Money already taken is harder to recover than money not yet taken.

Our guide to Form 843 refund claims covers recovering amounts.

Move before the bank sends the money, not after.

How long does a bank hold the funds?

An American bank holds the levied amount for three weeks before sending it. That window is the single best chance to get a release agreed, and it closes quietly. Anybody who finds a frozen American account should act the same day.

Three weeks is enough time if you start at once.

It is not enough if you wait for advice to arrive by post.

Does a joint account complicate an IRS levy?

It does, especially where a British spouse holds half. A levy can reach the account and the non-liable holder then has to prove their share, which is slow and unpleasant. Keeping separate accounts avoids the argument entirely.

Our guide to joint accounts for US-UK couples covers shared holdings.

Separate money is simpler money in a dispute.

Should you close your US accounts?

Not as a tactic, and this needs saying plainly. Moving assets to frustrate collection is a different and much more serious matter than simply living abroad. Tidying up dormant accounts for ordinary reasons is fine; emptying them after a final notice is not.

The distinction is intent, and it is visible in the timing.

Take advice before moving anything once letters have started.

What records should you keep?

Every notice with its envelope, your request for a hearing with proof of posting, and a dated note of every call. Those three decide whether you met the thirty days, which is the question everything else turns on.

Our guide to a tax transcript request covers checking the balance.

Get the account transcript before arguing about the figure.

Does an IRS levy affect your credit?

The lien behind it used to, and the agencies stopped recording them some years ago. So an American credit file is less affected than people fear. A British credit file never sees any of it, because the two systems do not talk to each other.

Our guide to a UK bank account closure covers British banking.

Lenders still see a lien on a property search.

Can a levy hit an inheritance?

Money due to you from an American estate can be reached, because the executor is an American payer. A British estate paying a British beneficiary is outside the system entirely. Which estate it is decides the answer, as usual.

Our guide to a US executor and a UK estate covers estates.

Timing an inheritance around a tax debt is unwise.

What about a US employer paying you here?

That salary is reachable, and it is the exposure people forget. Remote workers employed by an American company and living in Britain are paid by an American payer, so a wage levy can land on them like anybody else in Ohio.

Our guide to working remotely for a US employer covers that arrangement.

A wage levy continues until released rather than taking one payment.

Does bankruptcy stop it?

An American bankruptcy halts collection at once, and a British one does not. Insolvency in Britain has no automatic effect on an American tax debt, which surprises people who assume the two systems recognise each other. They do not.

Our guide to first time penalty abatement covers reducing the debt itself.

Take insolvency advice in the right country.

What does the IRS want to see?

A full picture of income and outgoings on their own financial statement. From Britain that means British figures converted into dollars, with housing and living costs that look high to an American eye. Explaining the cost of living here is part of the job.

Our guide to exchange rates on a US return covers the conversion.

Supporting documents matter more than the narrative.

Will they keep levying the same account?

A bank levy takes what is there on one day, so a repeat needs a fresh notice. A wage or pension levy works differently and continues automatically. That difference decides how urgent the situation really is.

One-off for banks, continuing for income streams.

A continuing levy needs stopping, not waiting out.

Is a levy common for expats?

Less common than the letters suggest. Most expat cases resolve through a plan or a settlement long before anybody seizes anything, and the passport route does more work than levies do. The letters are designed to prompt contact.

Our guide to IRS letters after streamlined covers correspondence.

Replying early keeps the file in the quiet part of the system.

Does a levy affect your UK tax?

Not directly, though the money taken is still yours for British purposes. A levy settling an American income tax debt is a payment of tax, so it may feed a foreign tax credit in the right year. The seizure itself is not a deductible event.

Our guide to Form 1116 income baskets covers the credit.

Keep the levy paperwork for the credit claim.

How to respond to an IRS levy notice

  1. Find the date on the notice and count thirty days from it.
  2. Confirm whether it is the final notice or an earlier demand.
  3. Pull your account transcript to check the balance is right.
  4. Request the collection hearing in writing, with proof of posting.
  5. List which of your assets are actually American.
  6. Propose a payment plan or a settlement at the same time.
  7. Act the same day if an American account is already frozen.
  8. Check your passport renewal position separately.

Mistakes and penalties we see with an IRS levy

The first is assuming distance is protection, and leaving an American brokerage account sitting there untouched.

The second is losing the thirty days to international post and forfeiting the stronger hearing.

The third is waiting until the bank has already sent the money, when a release would have been straightforward a fortnight earlier.

The fourth is moving assets after a final notice, which turns a collection problem into something far worse.

How US UK Tax Accountants helps

We map which of your assets are genuinely exposed first, because that usually shrinks the problem and tells you how much urgency it deserves.

Then we get a collection alternative in place, which stops the process. Our US federal returns service covers the filings underneath the debt.

Common questions on this topic

Can the IRS take money from my British bank?
Not directly. An American levy notice carries no legal force over a bank in Manchester, which has no obligation to act on it and generally could not lawfully do so. Your British current account is genuinely out of reach, which is why expats are told that so often.
What can they actually reach?

Is my social security safe?
Only partly. A continuing levy can take a fixed percentage of a social security payment rather than the whole amount, so some income survives. For a retired American abroad living on a fixed income, that is still a serious reduction month after month.
How much warning do I get?
A sequence of letters ending in a final notice of intent to levy, which carries a thirty day period and the right to a collection hearing. Everything before that letter is a demand rather than a threat, so look for the words final notice specifically.
What if the letter reaches me late?
That is the cruellest feature of the sequence for expats, because the thirty days runs from the notice date rather than from delivery. International post routinely eats half of it. Watching your IRS online account beats waiting for paper to cross the Atlantic.
